1. Definitions

• "Service" refers to vehicle rental services provided by noctissaws
• "User," "You," "Renter" refers to individuals or entities utilizing our services
• "We," "Us," "Our," "noctissaws" refers to the service provider
• "Vehicle" refers to any motorized transport provided under rental agreement
• "Agreement" refers to these Terms & Conditions plus rental contract
• "Rental Period" refers to time between vehicle pickup and return

2. Acceptance of Terms

By engaging noctissaws services, submitting rental requests, or operating rented vehicles, you acknowledge reading, understanding, and agreeing to these Terms & Conditions. These terms constitute a binding legal agreement between you and noctissaws.

If you do not agree with any provision, do not use our services. Continued use following any modification constitutes acceptance of revised terms.

3. Eligibility Requirements

To rent vehicles from noctissaws, you must:

• Be at least 21 years of age (25 years for performance vehicles)
• Hold a valid Singapore driving license or international driving permit
• Possess driving license for minimum 2 years (3 years for performance vehicles)
• Provide valid government-issued identification (passport or national ID)
• Present valid credit card in renter's name for security deposit
• Have legal capacity to enter binding contracts under Singapore law

We reserve the right to verify eligibility and refuse service to individuals not meeting requirements.

4. Booking and Confirmation

Booking requests are subject to vehicle availability. Confirmation occurs upon receipt of signed rental agreement and payment authorization. We reserve the right to decline bookings without explanation.

Advance Booking Requirements:

• Night Shift Sedan: Same-day booking available subject to availability
• Redline Performance: Minimum 3-day advance notice required
• Midnight Concierge: 24-hour advance notice preferred, 30-minute response guaranteed

5. Rental Fees and Payment

Pricing Structure:

• Base rental rate as quoted at booking confirmation
• Fuel charges (vehicle provided with full tank, return with full tank)
• Excess mileage charges: SGD 0.85 per kilometer beyond daily allowance
• Late return fees: SGD 50 per hour beyond agreed return time
• Additional driver fees if applicable: SGD 40 per day
• Airport pickup/delivery fees if requested: SGD 60

Payment Terms: Full payment required at rental commencement. Security deposit held on credit card (SGD 1,000 standard vehicles, SGD 3,000 performance vehicles). Deposit released 7-14 business days post-rental following vehicle inspection and outstanding charges settlement.

All prices quoted in Singapore Dollars (SGD) inclusive of applicable GST.

6. Cancellation and Refund Policy

Cancellation by Renter:

• More than 48 hours before rental: Full refund minus 10% administrative fee
• 24-48 hours before rental: 50% refund of base rental rate
• Less than 24 hours: No refund

Cancellation by noctissaws: We reserve the right to cancel bookings due to vehicle unavailability (mechanical issues, prior damage, safety concerns). Full refund provided with no penalties. We are not liable for consequential damages arising from cancellation.

7. User Responsibilities

As the renter, you agree to:

• Operate vehicle in accordance with Singapore traffic laws and regulations
• Maintain reasonable care and custody of vehicle during rental period
• Refrain from smoking, vaping, or transporting prohibited substances in vehicle
• Not permit unauthorized drivers to operate vehicle
• Not use vehicle for illegal purposes or commercial activities without authorization
• Not participate in racing, rallying, or competitive driving events
• Report all accidents, damage, or theft to authorities and noctissaws within 24 hours
• Return vehicle at agreed time and location in same condition as received
• Pay all parking fines, traffic violations, and toll charges incurred during rental

8. Prohibited Uses

Vehicles may not be used for:

• Transportation outside Singapore without prior written authorization
• Towing or pushing other vehicles
• Teaching driving lessons or driver testing
• Transportation of hazardous materials
• Operation while under influence of alcohol or controlled substances
• Subletting or unauthorized transfer to third parties
• Off-road driving or operation on unsuitable surfaces
• Overloading beyond manufacturer specifications

9. Insurance and Coverage

Standard Coverage Includes:

• Collision Damage Waiver (CDW) with SGD 3,000 excess (deductible)
• Third-Party Liability up to SGD 1,000,000
• Personal Accident Coverage for driver and passengers
• 24-hour roadside assistance within Singapore

Coverage Exclusions:

• Damage resulting from prohibited uses
• Intentional or reckless damage
• Damage to interior, tires, or undercarriage from misuse
• Loss of keys, accessories, or personal belongings
• Damage when driver under influence of substances

Renter remains liable for excess amount and excluded damage. Optional excess reduction packages available at additional cost.

10. Accidents and Damage

In event of accident or damage, renter must:

• Immediately notify Singapore Police if accident involves injury or third parties
• Contact noctissaws within 24 hours reporting full circumstances
• Obtain police report and accident documentation
• Not admit liability or make statements to third parties without our authorization
• Complete noctissaws accident report form
• Cooperate fully with insurance claims process

Failure to report accidents or provide required documentation may void insurance coverage, making renter liable for full repair costs.

11. Vehicle Return

Vehicles must be returned:

• At agreed date, time, and location specified in rental agreement
• With full fuel tank (fuel charges apply for insufficient fuel)
• In clean condition (interior cleaning fees apply for excessive dirt)
• With all accessories, documentation, and keys provided

Late returns incur SGD 50 per hour charges. Returns more than 3 hours late without prior authorization may be reported as stolen.

12. Limitation of Liability

Services provided "as is" without warranties of any kind. We are not liable for:

• Indirect, consequential, or incidental damages
• Lost profits or business opportunities
• Delays, breakdowns, or mechanical failures
• Loss of personal property left in vehicles
• Traffic violations, fines, or legal consequences from your operation

Maximum liability limited to total rental fees paid for affected rental period.

13. Indemnification

Renter agrees to indemnify and hold noctissaws harmless from all claims, damages, costs, and expenses (including legal fees) arising from:

• Your operation of rented vehicle
• Your violation of these Terms & Conditions
• Your violation of Singapore laws or regulations
• Claims by third parties resulting from your actions

14. Termination

We reserve the right to terminate rental agreement and demand immediate vehicle return if:

• Vehicle used in violation of these terms
• Payment obligations not met
• False information provided during booking
• Vehicle appears to be abandoned or illegally parked
• We believe vehicle safety or security is at risk

Termination does not relieve renter of payment obligations or liability for damages.

15. Governing Law and Jurisdiction

These Terms & Conditions are governed by laws of the Republic of Singapore. Any disputes arising from these terms or rental agreements shall be subject to exclusive jurisdiction of Singapore courts.

Parties agree to first attempt resolution through informal negotiation before legal proceedings.

16. Dispute Resolution

Informal negotiation required before formal legal action. If resolution cannot be reached within 30 days, parties may pursue:

• Mediation through Singapore Mediation Centre
• Arbitration under Singapore International Arbitration Centre rules
• Legal proceedings in Singapore courts

17. Severability

If any provision of these Terms & Conditions is found invalid or unenforceable, remaining provisions continue in full force and effect. Invalid provision shall be replaced with valid provision achieving similar economic effect.

18. Entire Agreement

These Terms & Conditions, together with rental agreement and any supplementary documents, constitute entire agreement between parties. No oral modifications or amendments are valid unless confirmed in writing.

19. Assignment

Renter may not assign or transfer rights or obligations under this agreement without our prior written consent. We may assign our rights and obligations to third parties without restriction.

20. Amendments

We reserve the right to modify these Terms & Conditions at any time. Changes become effective upon posting to our website with updated date. Continued service use after modifications constitutes acceptance. Material changes will be communicated via email where possible.
